Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") govern the sale of products by Raph & Joy LLC ("we," "us," or "our") to you, the customer ("you" or "your"), through our website at www.raphnjoy.com (the "Website"). By placing an order for products, you agree to be bound by these Terms.

This Website is not for use by any minors (defined as those who are not at least 18 years of age).

1. Home Bakery Disclaimer (as required by New Jersey law):
Raph & Joy operates as a fully licensed New Jersey Cottage Food Operator, holding all required food safety certifications. Our products are made in a home kitchen that is not inspected by the Department of Health, in compliance with New Jersey Cottage Food regulations.

2. Product Information and Availability
We make every effort to display accurate and up-to-date product information, including descriptions, pricing, and availability. However, we do not guarantee that all information is free of errors. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. All products are subject to availability, and we reserve the right to limit the quantity of products available for purchase.

3. Food Allergens
Our products are made in a home kitchen that also processes common allergens including milk, eggs, wheat, peanuts, tree nuts, and soy. While we take care to avoid cross-contamination, we cannot guarantee our products are allergen-free. All allergens are listed under each product.

4. Ordering and Acceptance
Order Placement: You can place an order by following the instructions on the Website. You are responsible for ensuring that all information you provide during the ordering process is accurate and complete.

Order Confirmation: After you place an order, you will receive an order confirmation email. This email is an acknowledgment that we have received your order, but it does not constitute our acceptance of your order.

Acceptance of Order: Our acceptance of your order and the formation of a contract of sale will occur when we deliver the products to you and email you confirming that the products have been prepared and good for delivery or pick-up. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

5. Pricing, Payment & Discounts
Pricing: All prices are listed in USD ($). Prices do not include delivery fees, applicable taxes or payment method fees, which will be added to your total at checkout.

Payment: We accept payment via credit card and all payment options will be listed on the checkout page. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method. A credit card processing fee may apply and will be clearly displayed at checkout on credit card payments, in compliance with applicable New Jersey law. This surcharge will be clearly disclosed at checkout.

Cash, check, Venmo and Zelle payment methods are not subject to any surcharge fee.

6. Pick-up and Delivery
Pick-up: Your products will be available to our home bakery location (Madison NJ 07940, USA). The exact address will be shared after the order validation. There is no addition fees for self-pick-up. Hours of operation for the pick-up are: Wed-Fri 9-5, Sat 9-4 and Sun 9-2.

Pick-up hours may vary on holidays or special occasions. Updated hours will be listed on our website and social media.

Delivery: Delivery dates and hours are estimates only and are not guaranteed. We are not liable for any delays in delivery. For local deliveries, once the products are left at your door or designated drop-off location, responsibility transfers to you. We are not responsible for spoilage or theft after delivery.

7. Returns and Refunds
Delivered & picked-up Orders: Due to the perishable nature of our products, we do not accept returns. 
However, if there is an issue with your order, please contact us within 24 hours with photos so we can review and resolve the situation.

If you have not received your product due to you having put the wrong or incomplete shipping address, then we cannot offer a refund or replacement.

If you (or someone else) are not present at the delivery time, the products will be left at your doorsteps under your responsibilities. 

We take great pride in our products and want every customer to be satisfied. If you believe there is an issue with your order, please contact us within 24 hours of receipt with a photo and description. Without a photo, we are unable to assess your claim. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your refund case, we require an order number or proof of purchase. To start a claim, you can contact us at hello@raphnjoy.com. If your claim is accepted, we will issue next steps via email.

Self pick-up: When you arrive to pick up your order, our team will hand your order to you. Due to the perishable nature of our products, we cannot offer a refund or exchange once your order has left our pick-up location.

Creative License: Each of our custom orders are hand- and homemade, meaning no two items will ever be exactly the same. Our web store shows all information possible. Please note, as all of our products are made with American buttercream, we are not always able to reproduce the exact shade/colour of a previous products. All our products are handmade and made to order, so slight variations in color, decoration, or texture may occur between batches — this is part of their artisanal nature.

Order Cancellations & Modifications: We understand plans change and are willing to accommodate changes to your order. However please note as changes require administration, there is a $5 admin fee for changes and/or cancellations. Within 3 days of collection, we are not able to accommodate changes to your order and have a strict no cancellations policy within this time frame.

8. Intellectual Property
All content on the Website, including text, graphics, logos, images, and software, is the property of Raph & Joy or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Website without our express written permission.

9. Limitation of Liability
To the fullest extent permitted by law, Raph & Joy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the sale of our products, including but not limited to loss of profits, data, or goodwill. Our total liability to you for any and all claims related to your purchase shall not exceed the total amount paid by you for the products in question.

10. Governing Law & Jurisdiction
These Terms will be governed by and construed in accordance with the laws of the State of New Jersey, and you submit to the non-exclusive jurisdiction of the state and federal courts located in New Jersey for the resolution of any disputes.

11. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. The Terms in effect at the time you place an order will apply to that order.
